Policies
2. The garage has been converted to a game room so vehicles must be parked in the driveway or on the street. If you park in the driveway do not park on the grass and try to avoid blocking the sidewalk. If you park on the street, park on the odd side of the street during odd months and even side of the street during even month. RV’s. trailers, boats and buses are not allowed on the resort.
3. Smoking is absolutely prohibited in or around the unit. If there is any tobacco smell in the unit there will be a $500 fee charged to Guest's credit card, as well as any additional associated costs to rid the unit of smoke smell and damage.
4. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. Guests are not allowed to exceed the occupancy limit agreed to.
5. Guests should not create excessive noise at a level that disturbs neighbors; Code- enforced neighborhood quiet hours are from 11:00 p.m. – 7:00 a.m.
6. Keep the property and all furnishings in good order.
7. Only use appliances for their intended use.
8. Pets are NOT allowed. If it is found that there are pets on the premises or if complaints come from neighbors about excessive noise due to the pets, Guest will be asked to vacate immediately with no refund. If there is evidence a pet was in the unit there will be a $300 fee charged to guest's credit card as well as any additional cleaning and sanitizing costs associated with removing all pet dander so that future guests with allergies can stay there. This may include but is not limited to carpet and upholstery shampooing with a special sanitizing cleanser, cleaning of all drapes and blinds, changing out furnace filters, extra cleaning to remove all pet hair from walls and baseboards, and the laundering of all linens including mattress pads, bed skirts, comforters, and throw pillows.
9. DVD’s and Video Games: The property comes furnished with DVD’s and video games that are available for Guest to use. All DVD’s and video games are inventoried prior to each new guest’s arrival. If any DVD’s or video games are found missing after check-out, Guest will be charged for the missing items.
10. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate.
11. Garbage: Any garbage must be stowed in the proper garbage or recycling receptacle, located at the side of the house.
12. Internet Use: Homeowner will provide Guest with access to WIFI at the rental property. Feel free to access your email, favorite websites, and movie streaming services such as Hulu, Netflix, Amazon, etc. You agree that you will not:
a. give out wireless internet password outside of this rental party;
b. reset the router or a modem, erase or modify the router password;
c. transmit or access any material that violate laws regarding copyright, trademarks, pornography or any material deemed slanderous, defamatory or offensive.
d. download from internet any material that infringes copyright or other proprietary rights of any party (P2P downloads like BitTorrent, etc.);
e. use the internet for excessively high-volume data transfers.
If the Internet Service Provider (ISP) notifies Homeowner that any of these violations occurred during your stay and criminal charges are brought forth, Homeowner will provide the law enforcement agency with contact information on the Guest.
13. Security of the Unit: When you rent the home, you assume responsibility for it and its contents, as well as any of your personal property in the home during your stay. Always lock the doors and windows when you leave. The front door keycodes are changed on a regular basis for security.
14. Risks/Safety: Children are welcome, however, there may be conditions in and around the home that may pose hazards to them, as well as to adults. Terence Purnell does not assume any liability or responsibility for any injuries occurring during your stay with us. Children must be supervised at all times. Candles are not allowed due to fire danger.
15. Repairs: Please call Citrus Grove Villas for any repairs at (863) 557-1545 and they will address your concerns as soon as possible. No refunds will be issued for malfunctioning equipment unless it poses a safety hazard, in which case a prorated refund will be given.
16. Telephones: Telephones may be used to make as many local as you wish at no additional charge. YOU MUST USE A PHONE CALLING CARD TO MAKE LONG DISTANCE, INTERNATIONAL OR OTHER CHARGEABLE TELEPHONE CALLS. Should any additional calling fees be inadvertently charged to the unit, Terence Purnell will charge the guest’s credit card number for such charges.
17. Insurance: Guest understands that Homeowner is not providing insurance for Guest’s personal property at the House. Guest shall look to their own insurance for coverage for its personal property in the event of a loss.
18. Hold Harmless: Terence Purnell does not assume any liability for loss, damage or injury to guests, their invitees or their personal property. Terence Purnell does not accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, electricity or plumbing, nor will Terence Purnell accept liability for any loss or damage caused by guests negligent or intentional conduct, weather conditions, natural disasters, acts of God, or other reasons beyond its control.
19. Pool and Spa: Guest hereby acknowledges that the home they have reserved includes a pool and spa, and that they are fully aware that the pool, spa and surrounding patio can be dangerous, that the patio can be slippery when wet, and that injury is likely to occur to anyone who is not careful. Guests should observe and adhere to all rules and policies as posted at the property. The undersigned guest accepts and assumes all risks involved in or related to the use of these aforementioned areas.
20. Additional Terms and Conditions: The undersigned guest, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Terence Purnell from any and all claims, demands and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Terence Purnell free and harmless of any claim or suit arising therefrom. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, Terence Purnell’s successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs. The venue of any action shall be the Osceola County Superior Court at Kissimmee.
21. Holdover: Guest has no right to Holdover. If Guest does not surrender and vacate the House at the end of the term of the agreement, Guest shall be a tenant at sufferance and the parties have agreed that the Rent shall be at the nightly rate of $425.00.
22. Miscellaneous: This agreement constitutes the entire agreement between the parties relating to the subject matter hereof, and supersedes all prior written oral negotiations, representations, or agreements. No modification of this agreement shall be binding on either party unless it is in writing signed by both parties. Each section, subsection or paragraph of this agreement shall be deemed severable and if for any reason any portion of this agreement is unenforceable, invalid or contrary to any existing or future law, such unenforceability or invalidity shall not affect the applicability or validity of any other portion of this agreement.
